congratulate the government for implementing a new Crown construction tendering agreement which gives union and non-union contractors equal access to government jobs and maximizes Saskatchewan employment, while ensuring that tradespeople receive fair treatment.

both the provincial and federal government for unfair agriculture budget cuts adversely effecting the Province of Saskatchewan; more specifically, the provincial government for undermining the stability of Saskatchewan farmers by cancelling thousands of GRIP contracts and eliminating support to Saskatchewan's agriculture sector; and the federal government for abolishing the Crow benefit without proper compensation and concise plans which will lead to rail line abandonment, low land values and increased costs to Saskatchewan producers.

That this Assembly urge the provincial government to press the federal government for fairness to western Canadian people in light of the federal government's minimal payout of the Crow Benefit, $7 billion cuts to health care and failing to defend western Canadian producers against railway strikes that are hindering the transportation of grain to export and therefore significantly increasing costs to producers to transport their grain.

STATEMENT BY THE SPEAKER

In the debate on the Report of the Driving Safety Committee earlier today, the Member for Maple Creek sought to table his own report separate from that of the Committee. While the Member has the right to express whatever views he wishes with respect to the Committee report, it is a longstanding practice that a Member of a Committee may not table a minority report or personal report in the House. In this regard I refer Members to Beauchesne's Parliamentary Rules and Forms, paragraph 870, page 240 as follows:

(1) It is the opinion of the committee, as a committee, not that of the individual members, which is required by the House, and, failing unanimity, the conclusions agreed to by the majority are the conclusions of the committee.

(2) It is the custom to include the opinions of dissenting members in a committee report. No separate minority report may be tabled in the House.

I also refer Members to a ruling of the Chair of this Assembly May 29, 1986 where an attempt to table a personal report was ruled out of order as not authorized by the Committee. I also refer Members to a ruling of this Assembly on May 22, 1980 where a minority report was not allowed to be attached to the report of the Committee.

I therefore find that the document requested to be tabled cannot be received.

Your Committee has considered the following Bills and has agreed to report the same without amendment:

Bill No. 01—An Act to amend An Act to incorporate the Briercrest Bible College

Bill No. 02—An Act to amend An Act respecting Our Lady of the Prairies Foundation

Bill No. 03—An Act to provide for the incorporation of The Manitoba-Saskatchewan Conference of the Seventh-day Adventist Church

The Committee has also considered Bill No. 04—An Act to amend An Act respecting Saskatchewan Wheat Pool, being an Act to amend and consolidate "An Act respecting Saskatchewan Wheat Pool, being an Act to amend and consolidate An Act to incorporate Saskatchewan Co-operative Wheat Producers Limited" and to enact certain provisions respecting Saskatchewan Wheat Pool. Pursuant to Rule 68, the Committee held 32 hours of public meetings to hear witnesses for and against the bill. The Committee heard from 70 witnesses and also received 10 written submissions. The Committee wishes to thank all those who participated in this process.

Your Committee has agreed to report Bill No. 04 without amendment.

Your Committee recommends, under the provision of Rule 61, that fees be remitted less the cost of printing with respect to Bill Nos. 01, 02 and 03.

Bill No. 52—An Act to amend The Teachers' Federation Act

The Orders of the Day having been called, Mr. Upshall, from his place in the Assembly, made a request pursuant to Rule 17 to move a priority of debate motion.

STATEMENT BY THE SPEAKER

Notice of this request for Priority of Debate under Rule 17 was received in the Clerk's Office at 11:43 a.m. today.

Revised rules for discussing matters of urgent public importance were adopted by this Assembly on March 1, 1994. This notice has not met the time requirements for filing the notice pursuant to Rule 17(2).

Also, under Rule 17(2), the notice is required to contain a statement why the matter is of urgent public importance. In this case, I find the Member has not attempted to make his case in his written notice as required under the Rule but rather appears to be simply giving notice of his intention to request leave to proceed with the motion.

I therefore find that the notice does not fulfill the requirements for a priority of debate under Rule 17.

Leave of the Assembly having been granted, pursuant to Rule 42, it was moved by Mr. Upshall, seconded by Mr. Carlson:

That this Assembly urge all federal Members of Parliament to co-operate in reaching an immediate conclusion to the current labour/managment dispute, and we demand that the federal government immediately begin work on a national transportation policy which would protect our producers and products by ensuring that Saskatchewan maintains its reputation as a reliable supplier of export products.

this Assembly urge the Premier to immediately communicate with his federal colleagues in the New Democratic Party an urgent message imploring the federal N.D.P. to cease their obstruction of federal back-to-work legislation that would force an end to the current rail strike and enable Saskatchewan farmers to get their grain to port.

join together in demanding the NDP and Bloc Quebecois coalition currently delaying passage of back-to-work legislation for Rail workers immediately cease their obstructionist tactics that are adversely affecting the grain industry in Western Canada and further that this Assembly show their allegiance to Saskatchewan farm families by forwarding a transcript of the debate on this motion to the Prime Minister, the Federal Labour Minister Lucienne Robillard, the NDP Leader Audrey McLaughlin and Bloc Quebecois Leader Lucien Bouchard.

That this Assembly records with sorrow and regret the passing of a former Member of this Assembly and expresses its grateful appreciation of the contribution he made to his community, his constituency and to the province.

CLARENCE LESLIE BALDWIN ESTEY who died in Saskatoon on March 5, 1995, was a member of this Legislative Assembly representing the Constituency of Saskatoon Nutana Centre from 1967 to 1971. Mr. Estey was born in Saskatoon on June 29, 1917. He received his early schooling at Albert and Victoria Schools and at Nutana Collegiate. He continued his studies at the University of Saskatchewan, from where he graduated with Bachelor degrees in Arts and in Law. On August 17, 1945, he married Virginia Grace Smith.

Mr. Estey was a barrister by profession and a noted jurist. His distinguished legal career began with his call to the Bar in 1941 and followed with his appointment first as Queen's Counsel in 1956 and later as a justice of the Court of Queen's Bench in 1974. He served on the Bench until his retirement in 1990. Mr. Estey was proud of his Saskatchewan roots and devoted much time and energy to the service of his community, his province and his country. His public service began immediately after his university graduation in 1941 when he enlisted in the 67th Light Anti Aircraft Battery of the Canadian Army. He served for three years in Britain before landing in Normandy a couple of weeks after D-Day. He was wounded in France during the Battle of Falaise near Caen and evacuated back to Canada.

At home in his community, Mr. Estey was a member of the Law Society of Saskatchewan, the Saskatoon Kinsmen Club, the Rotary Club and the YMCA. He served on the Saskatoon Public School Board for several terms and assumed the responsibility of Chairman of the Board. Mr. Estey was an active member of the Knox United Church. Local artists also benefited from his patronage as did his favorite sports teams, the Saskatchewan Roughriders and the University of Saskatchewan Huskies.

In 1967, the focus of Mr. Estey's public service shifted following his election to the Legislative Assembly. Mr. Estey held several cabinet portfolios during his term of office, including Municipal Affairs (1967), Indian and Metis Department (1969-1970), Industry and Commerce

  and Minister responsible for Saskatchewan Power (1970-1971). Although, Mr. Estey was unsuccessful in retaining his seat in 1971 he returned to his law practice and continued the pursuit of his many interests.

In recording its own deep sense of loss and bereavement, this Assembly expresses its most sincere sympathy with members of the bereaved family.

Ordered, That the Resolution just passed, together with a transcript of oral tributes to the memory of the deceased, be communicated to the bereaved family on behalf of this Assembly by Mr. Speaker.

STATEMENT BY THE SPEAKER

Standing on the Order Paper for Second Reading under the name of the Member for Souris — Cannington, is Bill No. 50, An Act to amend The Expropriation Act and The Expropriation Procedure Act (Land and Chattels). The bill was introduced on March 16, 1995.

It is the Speaker's duty to review all bills in respect to Rule 33 of the Rules and Procedures of the Legislative Assembly of Saskatchewan. The rule states, in part, that any bill which proposes to impose any new or additional charge upon the public revenue must be first recommended by the Lieutenant Governor before it is considered by the Assembly. I also refer Members to Erskine May's, Parliamentary Practice, (21st edition), where it is stated generally that a bill which contains provisions extending the purposes of expenditure already authorized by statute might require the royal recommendation. More specifically, on p. 715, May indicates that a bill which provides the extension of cases in which compensation can be paid requires the recommendation. In these respects Bill No. 50 was compared to the act it seeks to amend, namely The Expropriation Act (R.S.S. 1978, c.E-15). I find that the Member's bill proposes to extend the application of The Expropriation Act to chattels, including firearms, and in consequence would cause the Crown to provide compensation in the event firearms are expropriated. Therefore, I find that Bill No. 50 requires a recommendation from the Lieutenant Governor.

  In applying Rule 33, it is the practice of this Assembly to observe the parliamentary principle of the Crown initiative in financial matters. A ruling of the Speaker on March 30, 1965, confirmed this practice when it was stated that "nothing is more firmly established or clear than that the right to initiate legislation involving the collection and or the expenditure of public money rests solely with the Government..." Because Bill No. 50 requires a recommendation and because the Member for Souris-Cannington is not a member of the Executive Council, I must rule that the said bill is out of order.

The Order of the Day being called for the following Motion for a Seventy-five Minute Debate, it was moved by Mr. Martens, seconded by Mr. Britton:

That this Assembly strongly urge the provincial government to repeal the overly generous pension plan for Members of the Legislative Assembly elected previous to April 1979, which is an unfunded pension liability which burdens future generations, and instead urge the government to replace it with the new "defined contribution plan" to relieve Saskatchewan's over-taxed citizenry.

A debate arising, it was moved by Mr. Hagel, seconded by Mr. Cline, in amendment thereto:

That all the words after the words "this Assembly" be deleted and the following substituted therefor:

reaffirm the Province's commitment to honour its pension obligations to all those who contributed in good faith to the formula-based pension plan, including 104 former members of the Assembly or their surviving spouses, 3,300 former public service employees or their surviving spouses, and 5,500 superannuated teachers or their surviving spouses, who served the people of Saskatchewan in their professional careers; and further, reaffirm the Province's commitment to continue the defined contribution pension plan in place since April, 1979.

  During consideration of Bill No. 23—An Act to establish The Agri-Food Innovation Fund, it was moved by Mr. D'Autremont:

Clause 6 of the Printed Bill is amended by striking out the words "at least one-third" where they occur in subsection 6(1) and substituting the words "at least a majority".

The amendment was agreed to.

Moved by Mr. D'Autremont:

Clause 7 of the Printed Bill is amended by adding the words ", which shall include at least 50 per cent of the primary or secondary producers that are members of the Fund" immediately after the words "quorum of the Board" where they occur in subsection (7).
